Navodayansh Terms and Conditions of Provider’s contract
Navodayansh terms and conditions is the legal binding contract (hereinafter referred to as “Agreement”), by and between:
Practitioner(s) (defined hereinafter and referred to as “Provider” which expression shall, unless be repugnant to the context, be deemed to mean and include his/her/their heirs, executors, administrators and legal representatives its successors, as the case may be), i.e. any person, who accesses internet resource navodayansh.com or any other related online portal or data related to it, to avail Provider Services (defined hereinafter).
AND
Navodayansh Global Pvt Ltd, (hereinafter referred to as the “Company”) registered under the Section 7 of the Companies Act, 2013 (18 of 2013) and rule 18 of the Companies (Incorporation) Rules, 2014 which expression shall unless it be repugnant to the context or meaning thereof, be deemed to mean and include, its successors and assigns).
And each of which are hereinafter referred to as a “Party” and both of which are herein referred to as the “Parties”.
Navodayansh Terms and conditions to be read carefully before accessing related services of Navodayansh Global Pvt Ltd in terms of digital or any other media. This contract is a digital record in terms of Information Technology Act, 2000 and rules documented where it does not require any physical or digital signatures.
TERMS
- Navodayansh Terms and Conditions applies to healthcare providers who want to list themselves as “Provider” in the database of Navodayansh.
- By registering yourself as Provider you will be bound by this contract and to have read and understood and unconditionally accepted this Agreement.
- The Company is and the Provider accepts that the Company is the owner for providing Services.
- Provider has completed 18 years of age as on date registering for it.
- In case the Provider has any issue or difficulty with the understanding of its clause of this contract or portion, Provider is advised not to use any of the service of the Navodayansh.
PROVIDER OBLIGATIONS, UNDERTAKINGS AND CONSENT
- Provider warrants that you are not a person barred from Practitioner Services under the laws of India.
- Provider undertake to inform us of any pending or decided cases or complaint against him / her for medical negligence.
- Provider represent and warrant that you are qualified to provide medical services within the territory of India.
- Provider hereby undertake and agree that in case of any loss or injury caused to the Company or any third-party including other Users, due to the illegal activity committed through your account by you, you shall be solely responsible and liable for the consequences.
- Provider on successfully registering the account shall be responsible for maintaining the confidentiality.
- Provider hereby declare and verify that information provided is true and genuine.
- Provider agree that Navodayansh is authorized to verify your identity, qualifications, documents and credentials as a Practitioner.
- Provider agree that Navodayansh may terminate your access to use the services at any time if we are unable at any time to determine or verify Provider’s qualifications or credentials.
- Provider agree that Navodayansh may use and disclose your Practitioner Account information for such as inquiries and other third-party related concerns. Provider agree to hold them and us harmless from any claim or liability arising from the request for or disclosure of such information.
- The Company may, at its sole discretion, suspend Provider ability to use the services at any time while the Company investigates complaints or alleged violations of this Agreement, or for any other reason.
- The Company reserves, at its sole discretion, the right to refuse any Provider to access the Site or avail any Services, without assigning any reason.
- Provider hereby understand and agree that the relationship between you and the User or patient, shall be independently governed as per the Applicable Laws.
- Provider shall be solely liable for your dealings and interaction with patient or User, his/her representatives or affiliates.
- Provider will ensure that you are in compliance of all applicable laws, regulations and conventions.
- PROVIDER’S INFORMATION
Provider’s personal profile describing academic background, experience, credentials, awards shall be available for viewing by Users as per content display submission rights of the company.
- PRESCRIPTION
In case of Online Consultation, you can provide the prescription to your patients as per Medical Practitioner’s guidelines. The prescription is to be provided at your discretion and we will in no way be held liable for the content of the prescription and for the provision or lack of provision of the same to the User.
- FEEDBACK
We might send an SMS or email to the Users asking for feedback which may then be published on the Site. The Company shall not be liable, under any event, for any comments or feedback given by any of the Users in relation to the User Services provided by the Practitioner. In no event shall the Company be liable for any comments or feedback given by any of the Users in relation to the Practitioner Services provided by a Practitioner.
- CONTENTS AND BLOGS
We may offer forums for providing health related information to our Users such as Ask a Free Question and Health Articles. Participation in such forums is voluntary. You agree not to disclose individually identifiable health information of any person through such forums. You acknowledge that any liability resulting from your sharing of any information in any forum or discussion group, is your sole responsibility. You will hold the Company harmless for any damages, direct or indirect, arising from any post made by you.
- COMMUNICATION TO THE PRACTITIONER
You understand that once you register as a Practitioner on the Site, you hereby consent to be contacted by Company via phone, and/or SMS notifications, WhatsApp, email or any other mode of communication. You agree that the delivery of any communications from the Company shall be deemed to be effective, when sent by Company, through any mode of communication, regardless of whether you read the communication on receipt of it, or whether you actually receive the communication.
- DISCLAIMER
You hereby agree that use of the Practitioner Services is entirely at your own risk, cost and consequences. While every effort has been made to ensure that the information hosted on this Site is accurate & correct, however the Company does not warrant the accuracy of information obtained from Site or that it will not violate or infringe any third-party right in any manner, whatsoever.
- REFERENCE
You hereby allow us to provide your reference to other potential Practitioners and/or Lab that we would like to introduce to the Site as a referral to our Services.
- APPLICABLE LAW AND DISPUTE SETTLEMENT
You hereby agree that any action at law or in equity, arising out of or relating to these Terms and Conditions, including but not limited to arbitration or any issue arising out of the arbitration proceedings, appointment of arbitrator, grant of injunction, which is arising from this Agreement, shall be filed only in the Courts at Indore MP.
